By using this website and/or placing an order, you agree to be bound by the terms and conditions set out below.
1. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian to use/purchase/browse/contract from this website.
2. We have made every effort to display the color of our products that appear on the site as accurately as possible. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of color will be accurate.
3. www.mimmoorganics.com will not be responsible for any damage suffered by users from the use of the services on { www.mimmoorganics.com }. This without limitation includes loss of revenue or data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, negligence, defect, deletion, error, omission, interruption, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, or under any other cause of action.
4. Mimmo organics will take “Full Responsibility” of your Order, if the Order has been shipped to any of the major cities, where we used “Private Courier Companies” (eg. Blue Dart, GATI,First Flight, Pafex, DHL etc.) To ship your order.
5. We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the Site, including terminating, changing, suspending or discontinuing any aspect of the Site at any time, without notice. We may impose additional rules or limits on the use of our Site. You agree to review the Terms regularly and your continued access or use of our Site will mean that you agree to any changes. You agree that we will not be liable to you or any third party for any modification, suspension or discontinuance of our Site or for any service, content, feature or product offered through our Site.
6. All purchases through our website are subject to product availability.The prices and availability of products are subject to change without prior notice at the sole discretion of Mimmo Organics. For International deliveries, additional duties and taxes may be applicable for the ordered items as per your country’s regulations, which will be billed separately to you by the courier company at the time of delivery.
7. Request for cancellations of orders once placed on Mimmo organics shall not be entertained.
8. www.mimmoorganics.com reserves the right to refuse or cancel any orders placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment has been received. The payment shall be refunded and the User shall be informed of the same.
9. If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available) any extra cost spent by Mimmo Organics for re-delivery shall be claimed from the User placing the order.
10.The Users of this website agrees to give accurate, authentic and true information about yourself. Mimmo Organics reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly, Mimmo Organics has the right in its sole discretion to reject the registration and debar the User from using the services of Mimmo Organics without prior intimation whatsoever.
11. You agree, understand and confirm that the credit card details provided by you for availing of services on the Site will be correct and accurate and you shall not use a credit card which is not lawfully owned by you, i.e., in a credit card transaction, you must use your own credit card. Mimmo Organics will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user. The User must exclusively use his/her own card on the site.
12. Mimmo Organics shall not entertain any complaints after 12 days, once the order is delivered.
13. This agreement shall be construed in accordance with the applicable laws of India. The Courts at New Delhi shall have exclusive jurisdiction in any proceedings arising out of this agreement.
14. The trademarks, logos and service marks (“Marks”) displayed on the Site are our property. Users are prohibited from using any Marks for any purpose whatsoever without our prior written permission. All information and content including any software programs available on or through the Site (“Content”) is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes. The Site contain copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, designs, graphics, button icons, and page headers photos, video, graphics, music, sound, and the entire contents of the Company protected by copyright as a collective work under the applicable copyright laws, trademarks, service marks, or other proprietary rights and laws. The Company owns a copyright and other proprietary rights in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Users may not modify, distribute, copy, reproduce, publish, transmit, publicly display, adapt, edit, participate in the transfer or sale, license, rent, create derivative works, or in any way exploit, any of the content, in whole or in part. Users may download / print / save copyrighted material for the user’s personal use only. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express permission of the Company and the copyright owner is permitted. If copying, redistribution or publication of copyrighted material is permitted, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. The user acknowledges that he/she/it does not acquire any ownership rights by downloading copyrighted material.
15. The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of India may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient’s country. Additional charges for customs clearance must be fulfilled by the recipient; Mimmo Organics has no control over these charges, nor can Mimmo Organics predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for more information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.
